Notice of Proposed Rulemaking (NPRM)

On Dec. 22, 2010, the NLRB’s proposed rule, was published in the Federal Register (attached).  This Notice of Proposed Rulemaking (NPRM) proposes a regulation requiring employers subject to the National Labor Relations Act (NLRA) to post notices informing their employees of their rights as employees under the NLRA. The rule would apply to all private-sector employers covered by the NLRA, and not only those with Federal contracts or those with union employees.

 

The notices would be required to be posted physically “in conspicuous places, including all places where notices to employees are customarily posted.” Notices would also have to be distributed electronically, “such as by email, posting on an intranet or an internet site, and/or other electronic means, if the employer customarily communicates with its employees by such means.” 

 

The Board invites comments about the NPRM from interested parties, including, employers, employees, employer organizations, unions, public interest groups, and the public. Only comments submitted through http://www.regulations.gov, hand delivered, or mailed will be accepted. These methods for submitting comments are intended to be exclusive. Any ex parte communications received by the Board will be added to the public rulemaking record.  Deadline for comments is Feb. 22, 2011.

 

As you may remember back in January 2010, Obama signed an Executive Order (13496), requiring federal contractors to post the notice (attached) in the workplace. The DOL implemented the Order for federal contracts, new or modified, as of June 21, 2010 or later.
